Terms & Conditions

Acceptance

Participation in the "Cell Your Flash Game" contest (the "Contest") constitutes the entrants full and unconditional agreements to and acceptance of these rules, terms, and conditions.

Sponsors

The Contest is jointly sponsored by Lucrative Gaming, LLC, owners of FlashGameLicense.com ("FGL") and Adobe Systems, Inc. ("Adobe"). These entities together constitute the "Sponsors".

Contest Period

The Contest begins at 12:00:00am Coordinated Universal Time (UTC) on July 13, 2010 and ends at 11:59:59pm UTC on September 20, 2010.

Eligibility

This Contest is open only to entrants who meet the following criteria:

  • Entrant must be at least 18 years of age.
  • Entrant must be an authorized member of the FGL website. Non-members may register for a free FGL account at any time during the Contest Period.

How to Enter

No purchase is necessary to enter or win. This Contest is void where prohibited.

In order to enter the Contest, an entrant must upload a compiled Flash .swf file(the "Game") to the FGL website and mark that Game as an entry to the Contest during the Contest Period. In addition, entries must meet the Game Requirements described in the Game Requirements described below.

The Contest Sponsors reserve the right to disqualify entries at their sole discretion due to inappropriate or unlawful content, infringement of third party rights, false entrant information, or for any other reason.

Game Requirements

In order to be eligible for entry into the Contest, the Game must meet or exceed the following requirements:

  • The Game must be able to be played on an Android 2.2 smart phone (the "Device").
  • The Game must be of a high quality level and enjoyable to players.
  • The Game must scale appropriately to multiple screen resolutions, keeping buttons and interactive elements at a usable size.
  • The Game's rescaled user interfaces must work with game logic. For example, hunt-the-pixel games must not become unacceptably difficult.
  • Game input events that aren't supported on the Device - like mouse-over and mouse-move events - must not be important to gameplay.

Judging

Entries will be by a panel of Sponsor employees. Each entry will be evaluated based on the following criteria:

  • Artistic merit.
  • Graphical quality across a variety of screen resolutions.
  • Enjoyability of gameplay for typical users of the Device.
  • Performance on the Device.
  • Degree by which the Game exceeds the basic Game Requirements.

Although entries which contain non-English-language content may be submitted, the Sponsors will judge entries by their acceptability to an English-language audience.

Judging will begin after the end of the Contest Period and will be completed no later than October 12, 2010.

Prizes

Odds of winning a prize depend upon the number of eligible entries and the skill of the entrants. Prizes are as follows:

  • First place winner will receive $2600 USD and an authorized copy of CS5 Master Suite Software with cash value of $2600 USD.
  • Second place winner will receive $1600 USD and an authorized copy of CS5 Master Suite Software with cash value of $2600 USD.
  • Third place winner will receive $1100 USD and an authorized copy of CS5 Master Suite Software with cash value of $2600 USD.
  • Fourth, fifth, sixth, seventh and eighth place winners will receive $100 USD, an authorized copy of Flash CS5 Software with cash value of $700 USD, and 50 FGL "First Impressions" with a cash value of $50.
  • Nine and tenth place winners will receive $100 USD and 50 FGL "First Impressions" with a cash value of $50.
  • Eleventh through 150th place winners will receive $100 USD.

All eligible entries will be publicly displayed on a Flash game portal with promotion by commensurate to their place ranking. Display and promotion will last at least three months.

Any and all applicable tax on prizes are the sole responsibility of the entrant.

Ownership & License

Entrants retain all ownership rights in their Contest entry.

Contest participation grants the Sponsors a limited, royalty-free, non-exclusive, perpetual worldwide license to publicly display, use, reproduce and modify (for purposes of advertisement) the entry.

Winning entrants further agree to provide a version of their Contest entry with third-party ad services disabled. (Ads need only be disabled when the game is played on www.gameanyplace.com). Entrants must provide this version of the game before prizes will be awarded. Entrants must provide this version by December 31, 2010 or they forfeit their prizes.

The entrant represents and warrants that they have the right to grant this license as set forth and that the display of the entry does not violate any rights of any third party.

The entrant further agrees to pay all royalties, fees, or other monies owed to any person by reason of their entry.

Miscellaneous

Sponsors are not responsible for lost, late, incomplete, or damaged entries, nor for any computer, online or technical malfunction that may occur.

Sponsors reserve the right to cancel the Contest at any time for any reason.

Entrants and Sponsors acknowledge and agree that no partnership is formed by participation in the Contest.
